These Terms and Conditions (“Terms”) govern your use of the website and services provided by Yoga Wellness Therapy (“YWT,” “we,” “our,” or “us”), including the purchase and use of our digital and physical products. By accessing our website, purchasing any product or service, or participating in our programs, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our website or services.

1. Who We Are

Yoga Wellness Therapy (YWT) operates within the Yoga Parampara tradition and offers yoga education, wellness programs, consultations, rituals, and digital products (including online broadcasts, videos, and audio materials) as well as physical goods shipped worldwide. Our registered office is located in Latvia, and we comply with Latvian and European Union laws, including the General Data Protection Regulation (GDPR). 2. Scope of Services

YWT offers:

  • Digital Products: Online broadcasts of lectures, consultations/sessions (via Zoom or similar platforms), video & audio materials, and other digital products.

  • Physical Products: Books, wellness-related products, clothing, supplements, sound healing instruments and other items shipped internationally.

  • Private Sessions: Scheduled one-on-one or group sessions (online or in person).

  • Retreats: Private and public.

  • Corporate wellness packages.

  • Public events.

3. Eligibility

By purchasing or using our services, you confirm that:

  • You are at least 18 years old, or have parental/guardian consent if younger.

  • You will provide accurate, current, and complete information when purchasing or registering.

  • You are legally capable of entering into binding agreements under applicable law.

4. Payments and Third-Party Processing

Payments for purchases are processed via Foursquare and other authorized third-party payment providers. By completing a purchase, you agree to comply with the terms and privacy policies of these providers, as they act as independent controllers of payment data. All amounts are due at the time of purchase unless otherwise stated. Prices include VAT (if applicable) but exclude shipping, customs duties, or other applicable charges.

5. Delivery of Digital Products

  • Digital products (videos, broadcasts, audio files, consultations, etc.) are delivered electronically.

  • Access to broadcasts or consultations requires stable internet, appropriate software (e.g., Zoom), and functioning equipment.

  • Refunds are not provided for digital goods.

6. Scheduled Consultations

  • Clients must meet technical requirements and join on time for scheduled consultations/sessions.

  • Missed time due to late arrival or technical issues on the client’s side will not be compensated.

  • Rescheduling is permitted free of charge if requested at least 24 hours in advance by WhatsApp.

  • Requests made less than 24 hours before the session will be treated as cancellations and are non-refundable, exceptions are force majeure.

7. Physical Goods: Delivery and Risk

  • Physical goods are shipped from Latvia via Latvian Post or similar courier delivery service.

  • Liquid products or glass-packaged items are shipped only via express courier.

  • Delivery rates are indicated at the “check out”.

  • Once dispatched, risk of loss or damage passes to the customer.

8. Returns and Refunds

  • Digital Goods: Refunds are not available (except as required by law).

  • Physical Goods: Returns are accepted within 14 days of receipt, provided items are unused, in original packaging, and accompanied by proof of purchase.

  • Damaged, unsealed, or used items may be denied a refund or refunded only partially.

9. Intellectual Property

All content, materials, and functionality on the YWT website, including videos, texts, graphics, and trademarks, are the property of SIA WHITESTONE. They are protected by international copyright, trademark, and intellectual property laws. You may not copy, distribute, or exploit any content without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

  • YWT is not liable for delays, technical issues, or losses caused by third-party carriers, payment processors, or your own equipment and internet service.

  • YWT is not responsible for indirect or consequential losses, including loss of profits, data, or business opportunities.

  • YWT’s total liability will not exceed the total amount paid by you for the product or service giving rise to the claim.

11. GDPR & International Data Transfers

YWT processes personal data in accordance with the GDPR and Latvian law.

  • Your personal data is primarily stored and processed in the European Economic Area (EEA).

  • However, because we use Foursquare (a U.S.-based payment processor) and other service providers, your personal data may be transferred to countries outside the EEA.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Latvia and, where applicable, European Union law. Any disputes will be resolved by the courts of Latvia, unless otherwise required by mandatory consumer protection laws.

  • Nothing provided by YWT constitutes medical advice, diagnosis, or treatment, nor is it a substitute for consultation with qualified medical professionals.

Because YWT uses Fourqare, a U.S.-based hosting provider, some of your personal data may be transferred outside the European Economic Area (EEA).

Whenever we transfer personal data outside the EEA, we ensure it is protected by:

  • Adequacy decisions issued by the European Commission, or

  • Standard Contractual Clauses (SCCs) approved by the European Commission, which contractually oblige the recipient to protect your personal data to EU standards, or

7. How Long Do We Keep Your Data?

  • We retain your personal data for as long as your YWT account remains active.

  • If your account is inactive for two years, we might notify you by email and if account is not reactivated, we might delete your data.

  • Voluntary Data is retained for two years from submission before being anonymized.

  • We may retain data for longer where necessary to respond to complaints, claims, or legal obligations.

This Refund and Return Policy outlines the conditions under which refunds and exchanges are granted for both digital and physical goods, in compliance with applicable laws, including the General Data Protection Regulation (EU) 2016/679 (GDPR).

1. Refunds for Digital Goods

Paid digital goods include, but are not limited to, online broadcasts of lectures, courses, downloadable video and audio materials and books, yoga therapy sessions, and other digital content.

  • Refunds are not issued for digital goods.
    All purchases of digital content are final once access is granted, as these items cannot be returned.

  • Technical Issues
    If technical problems, internet connectivity issues, or other unforeseen circumstances disrupt a live broadcast or scheduled consultation (e.g., via Zoom or similar), please contact our support team at yogawellnesstherapyevents@gmail.com with a detailed description of the issue.
    Missed broadcasts or consultations are not refundable. YWT is not responsible for technical issues on the user’s side, it is the client’s responsibility to ensure punctual attendance and proper functioning of their equipment (including internet connection, microphone, camera, and any required software) for scheduled consultations. If the client fails to meet the technical requirements provided in advance or joins the session late, any missed consultation time will not be compensated or refunded. Consultations may be rescheduled free of charge if the client provides at least 24 hours’ notice prior to the scheduled session. Requests made less than 24 hours before the session may be subject to denial or additional fees.

2. Refunds and Returns for Physical Goods

  • Eligibility for Return
    You may request a return within 14 calendar days of receiving the product. After 14 days, we cannot offer refunds or exchanges.   • To qualify for a return:

    • The item must be unused, in its original condition, and returned in its original packaging.

    • A receipt or proof of purchase must be provided

  • Exclusions
    Refunds may be denied in the following cases:

    • The product shows signs of negligent use (e.g., scratches, visible damage).

    • The product is not returned in its original packaging.

    • The packaging is significantly damaged.

    • Seals on the product are broken.

  • Partial Refunds

  • Customers are responsible for all shipping costs, none of them will be covered by YWT.

  • Shipping fees are non-refundable. If your refund is approved, the cost of shipping will be deducted from the total refund amount.

  • For items valued over $75 (USD), we strongly recommend using a trackable shipping method or purchasing shipping insurance. We cannot guarantee receiving of your returned item.

Shipping & Delivery Policy of Yoga Wellness Therapy (YWT)

This Shipping & Delivery Policy (“Policy”) explains how Yoga Wellness Therapy (“YWT,” “we,” “our,” or “us”) handles the fulfillment, shipment, and delivery of physical goods purchased through our website and affiliated platforms.

All purchases are processed securely via third-party payment providers, including Foursquare and other authorized processors. Once your payment is confirmed, we will prepare your order for shipment. Yoga Wellness Therapy is solely responsible for the fulfillment and dispatch of physical goods.

2. Shipping Methods and Handling

All physical goods are shipped via: Latvian Post, Omniva, or Express Courier Delivery (mandatory for liquids or glass-packaged products). We package all goods carefully to reduce the risk of damage. However, YWT is not responsible for the handling practices of postal or courier services. Express delivery services typically offer more reliable handling, but neither postal nor courier providers guarantee protection against loss or damage.

3. Delivery Costs

Shipping costs are calculated based on the official rates of the selected courier service or as otherwise specified in your order confirmation.

You will receive a response to your order within three (3) business days of its receipt. Once dispatched, a tracking number might be provided to your registered email address, allowing to monitor your package’s progress on the carrier’s website.

4. Customer Obligations

You must provide a complete and accurate delivery address, including postal code, contact name, phone number, and valid email address. If incorrect or incomplete information results in delayed delivery, loss, or the need for re-shipment, all related costs will be borne by you, the customer. We do not ship to P.O. Boxes.

5. Customs, Taxes, and Duties

Your order may be subject to import duties, taxes, or customs fees, which are beyond our control and payable by you. YWT is not responsible for delays caused by customs processing.

6. Risk and Liability

Delivery is performed by independent third-party carriers. Accordingly, YWT cannot be held liable for:
